Massachusetts sexual harassment can be a sensitive and difficult topic to discuss, yet it is a serious problem that needs to be addressed immediately when it occurs. While Massachusetts sexual harassment is most frequently directed towards women, it is an issue that confronts both sexes. Massachusetts sexual harassment can take many forms, and can occur between members of the same sex.
Massachusetts sexual harassment, as set forth in Chapter 151B, Section 1(18) of the Massachusetts General Laws, is defined as:
“… sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when (a) submission to or rejection of such advances, requests or conduct is made either explicitly or implicitly a term or condition of employment or as a basis for employment decisions; (b) such advances, requests or conduct have the purpose or effect of unreasonably interfering with an individual's work performance by creating an intimidating, hostile, humiliating or sexually offensive work environment….”
Both federal law and Massachusetts state law also prohibit an employer from discriminating against an employee based on gender with regards to compensation, terms, conditions or privileges of employment.
When you are the victim of Massachusetts sexual harassment in the workplace, our Boston sexual harassment lawyers know that getting up in the morning can be extremely difficult. Massachusetts sexual harassment can be so abusive in nature that it takes such an emotional or physical toll as to make it impossible for an individual to perform his or her essential job functions.
Under Massachusetts law, it is illegal for a Massachusetts employer, co-worker or customer to sexually harass an employee at his or her workplace. Massachusetts law recognizes two types of sexual harassment in the workplace. Massachusetts quid pro quo harassment occurs when sexual favors are required as a condition of employment or advancement. Massachusetts hostile work environment harassment is when an employee is made to feel humiliated, violated or offended by sexual advances, requests or conduct at their workplace, to the point where it interferes with his or her job performance. Both types of Massachusetts sexual harassment are very serious and unacceptable. Massachusetts employers face harsh punishment under both Massachusetts and federal law if an employee can prove either of these types of sexual harassment.
Proving Massachusetts sexual harassment, however, is not always easy. It requires filling out paperwork and obtaining evidence, such as witness statements. The whole ordeal can be stressful and overwhelming, especially if you fear for your job status. Hiring a Boston sexual harassment lawyer with years of experience successfully handling Massachusetts sexual harassment claims can relieve some of your burden and guide you through the process. The Boston sexual harassment lawyers at the Law Offices of Gilbert R. Hoy Jr. and Affiliates have the skill and knowledge regarding Massachusetts sexual harassment to fully explain your rights to you and make sure that they are protected. Our Massachusetts sexual harassment lawyer specialists will get you the compensation that you deserve, and show abusive individuals that sexual harassment will not be tolerated.
Sexual assault is a sensitive topic that often significantly affects its victims both physically and emotionally. Generally, sexual assault is defined as improper conduct that occurs when an individual touches any part of another person’s body in a sexual manner, without that person’s consent. Sexual assault includes a number of different types of behavior, including rape, attempted rape, unwanted sexual contact or threats, sexual abuse, sexual misconduct, sodomy, fondling and indecent exposure.
Massachusetts General Laws, Chapter 265, Section 22(a) defines rape as occurring when an individual “has sexual intercourse or unnatural sexual intercourse with a person, and compels such person to submit by force and against his will, or compels such person to submit by threat of bodily injury and if either such sexual intercourse or unnatural sexual intercourse results in or is committed with acts resulting in serious bodily injury, or is committed by a joint enterprise, or is committed during the commission or attempted commission of an offense....” Additionally Massachusetts law includes all sexual acts involving vaginal, oral or anal sex.
Massachusetts General Laws, Chapter 265, Section 22(b) states: “Whoever has sexual intercourse or unnatural sexual intercourse with a person and compels such person to submit by force and against his will, or compels such person to submit by threat of bodily injury, shall be punished by imprisonment in the state prison for not more than twenty years; and whoever commits a second or subsequent such offense shall be punished by imprisonment in the state prison for life or for any term or years.” However, if an offender rapes a child under 16 years of age or commits aggravated rape against an adult, then he or she can face life in prison for the first offense.
